Terms and Conditions
Ticket Max Pte Ltd (“TicketMax Fiji”, “TicketMax”, “we”, “us”, “our”), a duly incorporated company registered in Fiji, provides online event ticketing services.
By using our services, the below terms and conditions below will automatically apply to you and your purchase of an event ticket. Please read the following terms and conditions carefully. Generally, you must be 18 years of age or older to purchase a ticket. However, for age-appropriate events such as school concerts, musicals, school tournaments, and similar events, ticket purchases by those under 18 are permitted. It is important you understand and agree with the following terms and conditions. You should not proceed with any purchase unless you do.
You may only use our services for your own personal use. You are not permitted to copy, modify, or alter in any way any of our services and all copyright, trademarks, and other intellectual property related to TicketMax Fiji remains the property of Ticket Max Pte Ltd
We act as an agent only. We offer a range of event and ticket management services (which may include but are not limited to: data collection, marketing, software design and software development services) on behalf of others who organize those events and who have been pre-approved by TicketMax Fiji to sell on the TicketMax software platform. Our duties to you are limited to arranging purchases on your behalf with those event providers. We are not responsible for providing those events to you, or for the standard of any event provided. If an event provider fails to provide you with an event, or you are not satisfied with the standard of any event provided, you agree that your only rights are directly against the event provider and not against us. You agree that we are not liable to you for any losses that you suffer in those circumstances, and that you will not claim against us (directly or indirectly) any refund, credit or other compensation. You agree that any money that you have paid to us will not be held on trust for you, but will be used by us to make payment to the event providers to secure the ticket, subject to availability, for your event.
LIMITATION OF LIABILITY
We do not accept any liability, whether in contract, tort or otherwise, for any act or omission of event providers including their failure to provide an event whether through their negligence or otherwise. We do not make any representation about the standard of the events to be provided by event providers, and we accept no liability in that regard. We do not accept any liability, whether in contract, tort or otherwise, for any injury, losses, expenses, delays or inconvenience suffered by you in connection with your event, unless our liability is prescribed by legislation which cannot be excluded. Without limiting the foregoing, we will not be liable for any loss of benefit or change in status relating to any loyalty, rewards, or other program which result from the actions of an event provider, including a change in event date and/or time or a change in event venue. Where our liability cannot be excluded, our liability is limited to the amount that you have paid for your event ticket.
RATES AND PRICES
Rates and prices quoted in print or on the website and quoted by our reservations personnel are subject to availability and can be withdrawn or varied without notice. Price changes may occur at any time by reason of matters outside our control which increase the cost of the event provided by the event providers. Such factors include but are not limited to adverse currency fluctuations, fuel surcharges, price increases made by event providers, taxes and event cost increases. Any price increase that is outside our control will be added to your account and is payable upon checkout, at our absolute discretion and where event providers permit we may also offer a refund. Rates and prices do not include any costs incurred en route to and from the destination, meals and/or alcoholic beverages, telephone calls, items of a personal nature, and personal services not specified as being included in costs on the relevant web pages for each event provider’s event.
Payments by M-PAISA
Please note that M-PAISA payments are processed instantly. If you are paying by this method, you will need to make sure you have sufficient funds in your M-PAISA account to make the payment.
Payment by Credit and Debit Card issued from Visa and MasterCard
Credit card surcharges apply and range between 2.5%- 5%, this surcharge will be advised on request and at time of charging. If you have paid any amount to us by credit card, you agree that you will not lodge any dispute with your credit card issuer about the validity of the transaction or the provision of goods or services by us, where an event provider fails to provide an event to you for any reason. You agree that your remedy lies against that event provider and not against us, and that by lodging a dispute with your credit card issuer you will be seeking a remedy against us in breach of these terms and conditions.
Payment by Cheque, Money Order or Cash
If you pay by cheque (including bank cheque), money order, Electronic Funds Transfer or cash, tickets can only be confirmed upon receipt of cleared funds. If you are paying by these methods, you will need to make payment at least 5 business days prior to the actual date due for payment. You agree not to stop payment even when you cancel a booking. You agree that we may apply the proceeds of the payment to satisfy any liability you have with us, including any liability in respect of cancellation fees, before refunding the balance to you.
CHANGING YOUR PURCHASE
You can cancel or amend your purchases at any time by contacting our Customer Service Team at [email protected]. Event providers are entitled to impose charges for cancellations or amendments, which can be up to 100% of the amount paid to them for the relevant event ticket. When you amend your purchase a $1.00 per ticket fee will be charged, together with any additional amendment fees applied by the event providers. When you cancel your purchase a $1.00 per ticket fee will apply to purchases, together with any additional cancellation fees applied by the event providers. Once/if we receive a refund from the event organiser, we will pass that refund onto you less the fees indicated. If events are cancelled by the event organiser due to COVID-19 or any other reason, your purchase will be subject to the applicable event policy effective at the time of cancellation, which may only offer the option of a ticket credit for the cancelled event. If you decide to cancel or modify your purchase, cancellation or amendment fees apply as per standard terms and conditions.
Other Service Fees:
We reserve the right to apply other service fees in addition to those charged by event providers, for any services provided by us in addition to those included in your ticket purchase. Some of these fees may include, but are not limited to, credit card surcharges, late purchase fees, processing fees and urgent ticket delivery.
Fiji tax is recorded on your ticket as being paid. All quoted taxes are subject to change.
Reservations (even after payment by you) are subject to us receiving confirmation from the event provider. In the rare instance where a reservation request cannot be confirmed by the event provider, you will be offered the choice of alternative arrangements (which may be with an alternative event provider), which may be at an additional cost or alternatively a full refund provided where the event provider allows. You agree that we are not liable to you for any such additional costs.
It is your responsibility to contact the event provider prior to the event to ensure the scheduled event date and time has not changed. We do not accept responsibility should changes occur nor do we accept responsibility for any additional cost incurred by you to make alterations to your purchase to accommodate these changes as these are beyond our control.
It is your responsibility to check the prevailing national COVID19 restrictions. Our event providers may also have additional restrictions, so it is your responsibility to check and meet these requirements. We recommend that you use the information on the Ministry of Health and event provider’s website to ensure that you are aware of the latest updates.The situation is fluid and as such country and entry and event provider requirements are changing frequently.
Health requirements are your individual responsibility.
** Should any mandatory quarantine or testing be required this will be at your own expense and for you to arrange.
** Please be advised that any costs for the above requirements will be at your own expense. Our consultants are not qualified to advise you on vaccinations. Please contact your own doctor or a specialist vaccination clinic.
MONIES NOT HELD ON TRUST
All monies paid by you to us will be the property of TicketMax Fiji and will be a debt due and payable to the event provider once the ticket/s for the event to which the money relates has been provided. TicketMax Fiji may change these terms and conditions from time to time, by publishing the changed terms and conditions on our website.
